These are the terms that govern your relationship with Natty Performance. Read them. They're straightforward.
1. Who These Terms Apply To
These Terms of Service ("Terms") apply to all visitors, customers, and users of the Natty Performance website (nattyperformance.com) and any purchases made through it. By accessing our site or purchasing from us, you agree to these Terms.
Natty Performance is operated by Natty Performance, located at 2135 East Sesame Street, Tempe, AZ 85283.
2. Products and Orders
Purchases: All purchases are subject to product availability. We reserve the right to limit quantities and to refuse or cancel orders at our discretion.
Pricing: All prices are listed in U.S. dollars. We reserve the right to change prices at any time. The price charged is the price displayed at the time of your order.
Payment: We accept Visa, Mastercard, American Express, PayPal, Shop Pay, and other payment methods as displayed at checkout. Payment is processed securely through Shopify Payments.
Subscriptions: If you subscribe to recurring orders, your payment method will be charged on the schedule you selected at enrollment. You may modify or cancel your subscription at any time through your account portal or by contacting us at barrett@nattyperformance.com.
3. Shipping and Delivery
We ship to addresses in the United States. Estimated delivery times are provided at checkout and are not guaranteed. We are not responsible for delays caused by carriers, weather, or events outside our control.
Risk of loss and title for products pass to you upon delivery to the carrier.
4. Returns and Refunds
If you are not satisfied with your purchase, contact us at barrett@nattyperformance.com within 30 days of delivery. We'll make it right.
We reserve the right to decline return or refund requests for products that have been partially consumed unless there is a documented defect or quality issue.
5. SMS / Text Message Marketing Program
By opting in to receive SMS messages from Natty Performance — through checkout, our website, a keyword, or any other subscription tool — you consent to receive automated recurring marketing and transactional text messages from us, including:
- Order confirmations and shipping updates
- Promotional offers and product launches
- Abandoned cart reminders
- Brand news and content
Message frequency varies. You may receive multiple messages per week depending on your activity and our current campaigns.
Message and data rates may apply. Standard rates from your wireless carrier may apply to messages you send and receive. Natty Performance does not charge for text messages.
Consent is not a condition of purchase. You do not need to opt in to SMS to buy from us.
How to opt out: Reply STOP to any text message from us at any time. After opting out, you will receive one confirmation message and no further marketing texts. You may also opt out by contacting us at barrett@nattyperformance.com. To opt back in, reply START or re-subscribe through our site.

Supported carriers: Major U.S. carriers are supported. Carrier is not liable for delayed or undelivered messages.
Changes to our number or short code: We reserve the right to change any telephone number or short code used to operate our SMS program at any time. You will be notified of such changes. Messages sent to a changed number or code, including STOP or HELP requests, may not be received during the transition, and we will not be liable for honoring requests made to outdated numbers.
Misdirected messages: To the extent permitted by applicable law, we are not liable for failed, delayed, or misdirected delivery of any text message, or for any action taken or not taken in reliance on a message.

6. Email Marketing
By subscribing to our email list, you consent to receive marketing emails from Natty Performance. You can unsubscribe at any time using the unsubscribe link in any email or by contacting us directly.
7. User Conduct
By using our site, you agree not to:
- Use the site for any unlawful purpose
- Attempt to gain unauthorized access to any part of our site or systems
- Scrape, copy, or redistribute site content without permission
- Submit false or misleading information
8. Intellectual Property
All content on nattyperformance.com — including text, images, graphics, logos, product names, and the "Fuel Your Sexy" mark — is the property of Natty Performance or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.
9. Disclaimer of Warranties
Our products and website are provided "as is." We make no warranties, express or implied, regarding the fitness of our products for any particular purpose beyond their intended use. Natty Performance bars are food products — they are not intended to diagnose, treat, cure, or prevent any disease.
10. Limitation of Liability
To the fullest extent permitted by law, Natty Performance shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our site or products. Our total liability for any claim arising from a purchase shall not exceed the amount you paid for the product in question.
11. Dispute Resolution and Arbitration
Informal Resolution: Before filing any claim, you agree to contact us at barrett@nattyperformance.com and give us 30 days to resolve the issue informally.
Binding Arbitration: If informal resolution fails, any dispute arising from these Terms or your use of our site or products shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. Arbitration will be conducted in Maricopa County, Arizona, unless the parties agree otherwise.
Class Action Waiver: You agree that any dispute will be resolved on an individual basis and not as part of any class, collective, or representative action. You waive any right to participate in a class action lawsuit against Natty Performance.
Opt-Out: You may opt out of this arbitration agreement by sending written notice to Natty Performance, 2135 East Sesame Street, Tempe, AZ 85283, within 30 days of your first purchase. Your notice must include your name, mailing address, and a clear statement that you wish to opt out of arbitration. Opting out will not affect your access to our products or services.
Exceptions: Either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration. Claims that fall within the jurisdiction of small claims court are not subject to arbitration.
12. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict of laws provisions.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. Continued use of our site after changes take effect constitutes acceptance of the updated Terms.
